When we meet for your free initial consultation we will better determine if you are able to adopt. In each Colorado adoption there are two basic questions the court must answer:

Are you qualified to adopt the child?

Is the child available to be adopted?

For example, in a stepparent adoption the court must consider whether or not the child you wish to adopt has been in your care for a long enough period of time (usually a year), along with your marital status, and your moral character, including criminal history and especially violent crimes or crimes against a child.

 If you qualify to adopt, then the child’s availability to be adopted must be determined. This depends upon whether or not the rights of the child’s biological parents can be terminated. For example, in a stepparent adoption, if the stepfather wishes to adopt his stepchild, then the court will look to see if there are grounds for terminating the biological father’s rights to the child, thereby making the child available to be adopted.  Our adoption attorney is prepared to fully advise you how to ensure your child can be adopted.

Grandparent, kinship, and custodial adoptions have similar rules.

Grounds to terminate the biological parent's rights include failure to pay reasonable support for a period set time set out by statute, abandonment of the child, or the biological parent’s consent to the adoption. The stepparent's spouse also needs to consent in a step adoption. If the child is old enough, then the child must also be willing to consent to the adoption.

The details and level of complexity in an adoption depend partly on the particular type of adoption in question (i.e., stepparent, grandparent, agency adoption, etc.). There are certain special rules that govern the adoption of American Indian children.
